Terms of Service

These Terms of Service (the “Terms”) are a legal agreement between you (“you”, “your”) and Lab 28 Technologies - FZCO (“Lab 28 Technologies”, “we”, “us”), a free-zone company registered in Dubai, United Arab Emirates. The Terms govern your access to and use of the Aria product, including the website at aria.28labs.ai, related APIs, the MCP server, and any associated services (collectively, “Aria” or the “Service”).

By creating an account, signing in, or otherwise using Aria, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use Aria.

Aria is an AI cofounder for operators. It connects to data sources you authorize (email, calendar, documents, integrations) and helps you triage, draft, decide, and automate work across them. Aria uses large language models (currently Anthropic Claude) to generate summaries, drafts, and recommendations. Aria's outputs are AI-generated and may contain errors; you are responsible for reviewing any action Aria proposes before relying on it.

• You must be at least 16 years old to use Aria.
• You must provide accurate information when signing up and keep it current.
• You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
• One account per individual. Account sharing is not permitted.
• If you use Aria on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You agree NOT to use Aria to:

• Violate any law or regulation, or infringe any third party's rights.
• Send unsolicited communications (spam) through any connected channel.
• Upload or process data you do not have the right to share.
• Reverse-engineer, scrape, or attempt to extract the underlying source code, models, or training data.
• Bypass, disable, or interfere with Aria's security, rate-limiting, or access controls.
• Use Aria to generate or distribute malware, phishing content, deepfakes intended to deceive, or content that harasses, threatens, or defames any person.
• Use Aria to make automated decisions that produce legal or similarly significant effects without human review.
• Use Aria's outputs to train competing AI models without our written permission.

We may suspend or terminate accounts that violate these rules without prior notice.

You own the data you bring to Aria (your email, calendar, documents, captured items, drafts, etc.). By using Aria, you grant Lab 28 Technologies a limited, non-exclusive, worldwide license to process that data only as necessary to provide the Service to you, as described in our Privacy Policy. We do not claim any rights in your content beyond what is necessary to operate Aria for you.

You are responsible for the accuracy, legality, and appropriateness of the data you share with Aria. Do not upload data you don't have the right to process.

Aria's outputs are generated by AI language models and may be inaccurate, incomplete, or misleading. You should independently verify any factual claim, draft, or recommendation Aria produces before acting on it. We do not warrant that AI outputs will be free of errors, suitable for any purpose, or non-infringing of third party rights.

Aria may create, modify, or delete content (e.g., calendar events, drafts) only when you explicitly authorize the action. You are responsible for any actions you direct Aria to take on your behalf.

Aria connects to third-party services you authorize (Google Workspace, Shopify, Airtable, etc.). Your use of those services is governed by their own terms and policies. We are not responsible for the availability, accuracy, or behavior of third-party services. If a third-party service changes, restricts, or removes access, your use of related Aria features may be affected.

Shopify integration. If you connect a Shopify store, you authorize Aria to read order, product, and (where granted) customer summary data via the Shopify Admin API. You can revoke this access at any time from your Shopify admin (Settings - Apps and sales channels - Uninstall Aria). Per Shopify Partner Program requirements, Aria honors the four mandatory compliance webhooks (customers/data_request, customers/redact, shop/redact, app/uninstalled) and deletes connection credentials on uninstall. See our Privacy Policy, Section 6, for details on Shopify data handling.

Some Aria features are offered under paid subscription plans. If you subscribe, you agree to pay the fees listed at checkout. Subscriptions renew automatically at the end of each billing period until canceled. You can cancel at any time; cancellation takes effect at the end of the current paid period and you retain access until then.

We may offer free trials. Trials convert to paid subscriptions automatically unless canceled before the trial ends. Prices may change with at least 30 days' notice; price changes do not apply to the current paid term.

All fees are non-refundable except as required by law. We may issue refunds at our discretion for service failures or other exceptional cases.

We aim for high availability but do not guarantee uninterrupted service. Aria may be unavailable due to maintenance, updates, third-party service outages, force majeure, or events beyond our reasonable control. We are not liable for any loss resulting from downtime or service interruption.

You may terminate your account at any time by emailing roger@28labs.ai. Upon termination, your access to the Service ends and your data is deleted per the retention schedule in our Privacy Policy.

We may suspend or terminate your access if you violate these Terms, if we are required by law, or if we discontinue the Service. We will give you reasonable notice unless prevented by an emergency, abuse situation, or legal obligation.

Aria, including its software, design, models, branding, and documentation, is owned by Lab 28 Technologies and protected by applicable intellectual property laws. These Terms grant you a limited, revocable, non-transferable license to use Aria for your own internal business purposes only. All rights not expressly granted are reserved.

Aria is provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of AI-generated outputs. We do not warrant that Aria will be error-free, secure, or always available.

To the maximum extent permitted by law, Lab 28 Technologies and its officers, directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, business, or goodwill, arising out of or related to your use of Aria, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or related to Aria will not exceed the greater of (a) the fees you paid us in the 12 months preceding the claim or (b) USD 100.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify and hold harmless Lab 28 Technologies from any claim, demand, loss, or damage (including reasonable legal fees) arising out of (a) your use of Aria, (b) your violation of these Terms, or (c) your violation of any third party right, including any intellectual property or privacy right.

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or Aria will be resolved exclusively in the courts of the Dubai International Financial Centre (DIFC), and you consent to the jurisdiction of those courts.

We may update these Terms from time to time. Material changes will be notified by email to the address on your account and announced in-app at least 30 days before they take effect (or sooner if required by law). Your continued use of Aria after the effective date constitutes acceptance of the updated Terms. If you do not accept the changes, you must stop using Aria and may terminate your account.

• If any provision of these Terms is found unenforceable, the remaining provisions remain in force.
• Our failure to enforce any provision is not a waiver of our right to do so later.
• You may not assign or transfer your rights under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
• These Terms, together with our Privacy Policy, are the entire agreement between you and Lab 28 Technologies regarding Aria.
